The North Dakota Automobile Assigned Claims Plan (NDAACP) is an association made up of auto insurance companies selling no-fault insurance in North Dakota. The NDAACP, established by N.D.C.C. § 26.1-41-18, provides basic no-fault benefits to individuals injured in automobile accidents if they suffer an economic loss as a result of the injury. In order to be eligible for benefits through the NDAACP, an individual must, through no fault of his or her own, be ineligible for no-fault benefits through an insurance company or the available no-fault benefits must be less than is called for under the contract because of the financial inability of the insurance company to pay.
